These Terms govern your use of Emberwell ("the app"), provided by Matthew Brestelli. By using the app you agree to these Terms.
Emberwell is a general wellness and tracking tool. It does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional care. Always consult a qualified clinician about your symptoms and health decisions. If you think you may have a medical emergency, contact emergency services.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own personal, non-commercial use, subject to these Terms and the app store terms you purchased through.
Emberwell offers optional premium features via subscription (monthly or annual) and a one-time lifetime purchase. Purchases are billed through your Apple or Google account. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period; manage or cancel in your app store account settings. Prices and terms are shown at purchase. Refunds are handled by Apple or Google under their policies.
The app may let you gift premium access or contribute to a pool that funds free access for others. Gift codes and sponsored memberships have no cash value, are non-refundable once redeemed, and may be subject to reasonable limits to prevent abuse.
The information you log is yours. You're responsible for the accuracy of what you enter and for keeping your device secure. You can export or delete your data at any time from within the app.
Don't misuse the app: no attempts to break, reverse-engineer, or disrupt it, and no use that violates law.
The app is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that any insight it generates is accurate for your situation.
To the fullest extent permitted by law, Matthew Brestelli will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app.
You may stop using the app at any time. We may suspend or end access if these Terms are violated.
We may update these Terms; we'll revise the effective date and, for material changes, provide notice in the app.
These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-laws rules.
